As a parent/legal guardian of the Berkeley County Sheriff’s Office “SUMMER CAMP” applicant, I authorize Berkeley County Sheriff’s Office to conduct a background check that will include a review of the applicant’s School Disciplinary Records. I understand that, and have no objection with, the results of this review potentially disqualifying the applicant from attending the Berkeley County Sheriff’s Office “SUMMER CAMP.” I further understand that such disqualification is in the sole discretion of the Berkeley County Sheriff’s Office and have no objection with the same.

As a parent/legal guardian of the Berkeley County Sheriff’s Office “SUMMER CAMP” applicant, I give consent for the applicant to be videotaped, interviewed, and/or photographed during Berkeley County Sheriff’s Office “SUMMER CAMP” and I consent to the same being used in Berkeley County Sheriff’s Office press releases and other promotional materials.

The Berkeley County Sheriff’s Office (herein also referred to as “BCSO”) is sponsoring the BCSO SUMMER CAMP as a voluntary recreational service to the community for the purposes of promoting public safety education, physical activity, and good, clean fun. Please be informed that a recreational program by nature is not without risk. The same elements that contribute to the unique character of a recreational program like BCSO SUMMER CAMP, for example exposing oneself to the natural elements, can result in accidental injury, illness, or in extreme cases, permanent trauma, or even death. By providing this information, BCSO does not intend to reduce enthusiasm for, or discourage the applicant from participating in, the BCSO SUMMER CAMP, but is rather identifying the possibility of risks, both known and unknown.

ACKNOWLEDGMENT OF RISK

I hereby certify, as parent/legal guardian, for the applicant that the applicant is in good physical condition, and fully capable of participating in the BCSO SUMMER CAMP. I acknowledge that I have read the above statement regarding the potential risks involved with BCSO SUMMER CAMP and I willingly, knowingly, and freely assume all such risks, both known and unknown, even if arising from the negligence of those indemnified and released from liability below. I willingly assume full responsibility for the applicant’s expenses, loss of personal property, bodily injury and/or death, arising out of, or in any way connected with, the BCSO SUMMER CAMP.

WAIVER AND RELEASE

AS PARENT/LEGAL GUARDIAN FOR THE APPLICANT, I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS THE BERKELEY COUNTY SHERIFF’S OFFICE, ITS EMPLOYEES, ITS OFFICERS, AGENTS, AND/OR CONTRACTORS (hereinafter also referred to as “RELEASEES”) FOR AND AGAINST ANY AND ALL DAMAGES, LOSSES, SUITS, LIABILITY AND/OR CAUSES OF ACTION RESULTING FROM PROPERTY DAMAGE, AND/OR PERSONAL INJURY, INCLUDING DEATH OF THE APPLICANT, ARISING OUT OF OR IN ANY WAY CONNECTED WITH, THE APPLICANT’S PARTICIPATION IN THE BCSO SUMMER CAMP, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, EXCEPT TO THE EXTENT THAT SUCH DAMAGE OR INJURY IS CAUSED BY GROSS NEGLIGENCE AND/OR WILLFUL MISCONDUCT, AND COVENANT NOT TO SUE OR TAKE ACTION AGAINST BERKELEY COUNTY SHERIFF’S OFFICE, ITS EMPLOYEES, ITS OFFICERS, AGENTS, AND/OR CONTRACTORS EXCEPT AS SET OUT HEREIN.

CONSIDERATION

As parent/legal guardian for the applicant, and in consideration of the applicant’s right to be allowed to participate in the BCSO SUMMER CAMP, I acknowledge that I have read all of the information set forth in the ACKNOWLEDGMENT OF RISK, WAIVER, AND RELEASE, fully understand the terms of the same, fully understand that I am giving up substantial rights, and freely, knowingly, and voluntarily agree to be bound by the same without any inducement.
